Terms of sale
1. Seller
2J LAMBRE, a French simplified joint-stock company with a single shareholder (SASU) with share capital of €5,000, registered with the Paris Trade and Companies Register under number 837 878 925. Head office SIRET: 837 878 925 00028. EU VAT number: FR30 837 878 925. Registered office: 10 rue de Penthièvre, 75008 Paris, France. President: Jocelyn LAMBRE.
Contact: contact@2jagency.com. Customer service by email (reply within 2 business days).
2. Scope
These terms apply to sales of digital files made by 2J LAMBRE, to consumers and businesses alike. Products sold through Google Play, Amazon Kindle, Kobo or Notion Marketplace are governed by those platforms’ terms. Files sold on Payhip or Etsy are sold by 2J LAMBRE under these terms. Placing an order means accepting these terms.
3. Products
Products are downloadable digital files, in particular Excel files (templates and calculators). No product is currently sold directly on this site. When a product is offered, its essential characteristics are described on its page. An Excel file requires compatible software (for example Microsoft Excel), which the buyer must have.
4. Prices
Prices of digital files are shown in euros, all taxes included, as displayed on the product page at the time of the order. 2J LAMBRE may change its prices at any time; the price that applies is the one shown when you order.
5. Ordering and payment
When a file is sold directly on this site, payment is made online when ordering, through the payment provider Stripe. 2J LAMBRE has no access to your card details. Stripe emails you a payment receipt.
On Payhip, payment is processed through Stripe or PayPal, depending on the method chosen at checkout; on Etsy, it is processed by Etsy’s payment service (Etsy Payments). In both cases the receipt is sent by the platform, and 2J LAMBRE has no access to your card details.
6. Delivery
A file is delivered immediately after payment is confirmed, through a download link; for an order placed on Payhip or Etsy, the link is provided by the platform. If you do not receive the link, write to the contact address.
7. Right of withdrawal
Consumers have 14 days from the conclusion of the contract to withdraw from it, without giving any reason and without any cost (Articles L221-18 et seq. of the French Consumer Code). 2J LAMBRE then refunds all sums paid no later than 14 days after receiving the withdrawal, using the same means of payment (Article L221-24).
Files delivered immediately (Article L221-28 13°). The right of withdrawal can no longer be exercised once supply of the file has begun if, before payment, the consumer has both given their prior express consent for supply to begin before the end of the withdrawal period and expressly acknowledged that they thereby lose their right of withdrawal. This consent and acknowledgement are confirmed to them on a durable medium, by the order confirmation sent by email (Article L221-13). Depending on the sales channel:
- direct sales on this website: no file is sold here at present; if direct sales open, the consent and acknowledgement will be collected before payment through unticked checkboxes, then included in the order confirmation sent by email;
- Payhip: a mandatory checkbox before payment (Payhip “Legal” question type); the buyer’s answer is shown in the receipt Payhip sends them by email;
- Etsy: for buyers in the European Union, Etsy requires them, before completing the purchase of a digital item, to tick a box acknowledging that they lose their right of withdrawal when downloading; Etsy then sends the order confirmation by email.
If, for an order, the consent and acknowledgement were not collected before payment, or were not confirmed on a durable medium, the 14-day withdrawal period applies to that order.
How to withdraw. Use the Withdraw from contract link: it opens a pre-filled email to contact@2jagency.com. You may also use the model withdrawal form below, or any other unequivocal statement. For an order placed on Etsy, you may also use the withdrawal request offered by Etsy in its order help. 2J LAMBRE acknowledges receipt of your withdrawal without delay, by email.
8. Legal guarantee of conformity
Consumers benefit from the legal guarantee of conformity for digital content (Articles L224-25-1 et seq. of the French Consumer Code) and the legal guarantee against hidden defects, as set out below.
Legal guarantees (model annexed to Article D211-3 of the French Consumer Code)
The consumer has two years from the supply of the digital content or digital service to obtain the application of the legal guarantee of conformity if a lack of conformity appears. For one year from the date of supply, the consumer only has to prove that the lack of conformity exists, not when it appeared.
The legal guarantee of conformity includes the obligation to supply all updates needed to keep the digital content or digital service in conformity.
The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay after the request, free of charge and without significant inconvenience.
The consumer may obtain a price reduction while keeping the digital content or digital service, or may end the contract and obtain a full refund in exchange for giving up the digital content or digital service, if:
- 1° the trader refuses to bring the digital content or digital service into conformity;
- 2° bringing the digital content or digital service into conformity is unjustifiably delayed;
- 3° the digital content or digital service cannot be brought into conformity without costs imposed on the consumer;
- 4° bringing the digital content or digital service into conformity causes significant inconvenience to the consumer;
- 5° the lack of conformity persists despite the trader's unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a price reduction or to terminate the contract when the lack of conformity is so serious that an immediate price reduction or termination is justified. The consumer then does not have to request conformity first.
Where the lack of conformity is minor, the consumer is entitled to cancel the contract only if the contract does not provide for payment of a price.
Any period during which the digital content or digital service is unavailable for the purpose of bringing it back into conformity suspends the remaining guarantee period until the conforming digital content or digital service is supplied again.
These rights result from Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.
A trader who in bad faith obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (Article L. 242-18-1 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund in exchange for giving it up.
English translation for information; the French text of the CGV, which reproduces the official model word for word, prevails.
If a file is defective, does not open or does not match its description, write to contact@2jagency.com.
9. Liability
Calculators and templates provide estimates based on the data you enter. They are not accounting, tax or legal advice, nor a guarantee of results or income. You remain responsible for your choices and prices. Towards a consumer, 2J LAMBRE is liable for damage under ordinary law, without any contractual limitation. Towards a business client, 2J LAMBRE’s liability is limited to the price paid for the product concerned.
10. Personal data
Data needed for your order is processed in accordance with our privacy policy.
11. Complaints and disputes
In case of a dispute, please first write to the contact address so we can look for an amicable solution. Complaints: write to contact@2jagency.com; we reply within 2 business days. If no amicable solution is found, consumers may refer the matter to the competent court.
12. Governing law
These terms are governed by French law. Failing an amicable agreement, disputes are brought before the competent courts; for business-to-business sales, the courts of Paris have sole jurisdiction.
